These Terms of Service ("Terms") govern your use of the website at www.the-solutioner.com (the "Website"). By accessing or using the Website, you agree to be bound by these Terms. If you do not agree, please do not use the Website.

Scope: These Terms cover the use of this Website only. They do not govern the concierge, villa rental, property management, transport, or event-planning services we provide to our clients. Those services are subject to separate contractual agreements concluded between you and us in writing before any service is rendered.

2. Permitted Use

You may browse and use the Website for personal, non-commercial purposes and to enquire about our services. You agree NOT to:

  • Use the Website in any way that violates applicable law or these Terms.
  • Submit false, misleading, or impersonating information through the contact form.
  • Attempt to gain unauthorised access to the Website, the server it runs on, or any related systems.
  • Interfere with the Website's normal operation (e.g. denial-of-service attempts, vulnerability scanning without our prior written permission, automated scraping at a rate that degrades service).
  • Use the Website to send unsolicited commercial communications, spam, or any content that is unlawful, defamatory, obscene, or infringing.
  • Copy, reproduce, redistribute, or create derivative works of the Website content beyond what is permitted by applicable copyright exceptions.

3. Intellectual Property

All content on the Website — including text, images, photography, videos, logos, the "The Solutioner" name and brand identity, and the design of the pages — is owned by us or our licensors and is protected by applicable copyright, trademark, and other intellectual-property laws.

Limited personal viewing in your browser is permitted. Any other use — copying, republishing, redistributing, framing, or incorporating into other works — requires our prior written consent.

Third-party assets (e.g. fonts licensed from Google Fonts under the SIL Open Font License, the vendored PHPMailer library under the LGPL) are used in accordance with their respective licenses.

4. Contact Form

The contact form on /contact is provided so you can ask about our services. By submitting the form you confirm that:

  • The information you provide is accurate and you are entitled to provide it.
  • You consent to the processing of your data for the purpose of responding to your enquiry, as described in our Privacy Policy.
  • Submitting the form does not create a contract for any service. Any service we offer is subject to a separate agreement.

We may decline to respond to enquiries that appear abusive, fraudulent, or unrelated to our services. We use Google reCAPTCHA to reduce automated abuse; see the Privacy Policy for details.

5. No Service Contract via the Website

The Website is purely informational. Descriptions of villas, services, prices indicated in marketing material, and any other content are not an offer in the legal sense and are subject to change. No contractual relationship for any of our services arises from your use of the Website. Bookings, quotations, and service agreements are concluded only through separate written communication (e.g. signed quotation, service agreement, booking confirmation).

6. External Links

The Website may contain links to third-party websites (for example to Google's policies, the Spanish AEPD, or partner sites). Those websites are not under our control. We do not endorse them and accept no responsibility for their content, availability, or privacy practices.

7. Availability and Disclaimers

We make reasonable efforts to keep the Website available and the information accurate, but:

  • The Website is provided "as is" and "as available", without warranties of any kind, whether express or implied (including merchantability, fitness for a particular purpose, or non-infringement), to the maximum extent permitted by applicable law.

Subject to mandatory consumer-protection rules that may grant you the right to bring proceedings in the courts of your country of residence, any dispute arising out of these Terms shall be submitted to the courts of the Balearic Islands, Spain.
