Privacy Policy

This Privacy Policy explains how The Solutioner ("we", "us") collects, uses, and protects your personal data when you visit www.the-solutioner.com (the "Website"). It is provided in accordance with the EU General Data Protection Regulation (GDPR, Regulation 2016/679) and Spanish data protection law (LOPDGDD 3/2018).

We have not appointed a Data Protection Officer (DPO). Under GDPR Article 37, the appointment of a DPO is not required for our processing activities, which do not involve large-scale monitoring of data subjects or processing of special categories of data.

2. What Data We Collect and Why

2.1 Contact form

When you submit the contact form on /contact, we process the following data:

  • Name (required) — to address you personally in our reply.
  • Email address (required) — to send you a response.
  • Phone number (optional) — only if you choose to provide it.
  • Subject and message (required) — the content of your enquiry.

Legal basis: Performance of pre-contractual measures at your request (GDPR Art. 6(1)(b)) and, for any optional fields, your consent (Art. 6(1)(a)).

Recipient: Messages are delivered by email to our own inbox (hello@the-solutioner.com) via our hosting provider's SMTP server.

Retention: We keep contact-form correspondence for as long as needed to handle your enquiry and any resulting business relationship, plus the legal retention periods required by Spanish tax and commercial law (typically up to 6 years). You may request deletion at any time (see Section 5).

2.2 Google reCAPTCHA (contact form spam protection)

To protect the contact form from automated abuse, we use Google reCAPTCHA v2 provided by Google Ireland Limited (Gordon House, Barrow Street, Dublin 4, Ireland). reCAPTCHA analyses signals from your browser and device to determine whether you are a human. This may include your IP address, mouse movements, browser metadata, and cookies set by Google.

Legal basis: Your consent (GDPR Art. 6(1)(a)), obtained via our cookie banner under the "Functional" category. reCAPTCHA is not loaded until you grant functional consent. If you do not consent, you will not be able to submit the contact form; you can reach us by email at hello@the-solutioner.com instead.

Transfer outside the EU: reCAPTCHA processing may involve transfers to Google LLC in the United States. Google relies on the EU–U.S. Data Privacy Framework (adequacy decision adopted by the European Commission on 10 July 2023) as the basis for these transfers.

2.3 Google Analytics 4

To understand how visitors use the Website and to improve it, we use Google Analytics 4 provided by Google Ireland Limited. Google Analytics may collect:

  • Truncated IP address (we have enabled anonymize_ip so the last octet is removed before storage)
  • Browser, operating system, and device type
  • Approximate location (country / region) derived from the IP address
  • Pages visited, referring URL, time on page
  • An anonymous identifier stored in cookies (typically _ga, _ga_*)

Legal basis: Your consent (GDPR Art. 6(1)(a)), obtained via our cookie banner under the "Analytics" category. Google Analytics is not loaded until you grant analytics consent.

Transfer outside the EU: Data may be transferred to Google LLC in the United States under the EU–U.S. Data Privacy Framework.

Retention: Up to 14 months on Google's servers (Google Analytics 4 default), after which data is automatically deleted.

You can withdraw consent at any time on our /cookie-settings page, or install Google's Analytics Opt-out Browser Add-on.

2.4 Server logs

Our hosting provider automatically writes standard web-server access logs for the purposes of operating, securing, and troubleshooting the Website. These logs may include:

  • Your IP address
  • Date and time of the request
  • The URL requested and HTTP status code
  • Your browser's User-Agent string
  • The referring URL, if any

Legal basis: Our legitimate interest in maintaining a secure and reliable service (GDPR Art. 6(1)(f)).

Retention: Typically up to 30 days, after which logs are rotated and overwritten.

3. Cookies and Similar Technologies

We use cookies and similar technologies grouped into three categories:

4. Data Recipients

We do not sell, rent, or trade your personal data. We share data only with the following categories of recipients, strictly as needed to operate the Website:

  • Our hosting provider — for storage and delivery of the Website and processing of the contact form.
  • Google Ireland Limited / Google LLC — for Google Analytics and reCAPTCHA, only with your consent.
  • Public authorities — only where required by law (court orders, tax inspection, etc.).

5. Your Rights Under GDPR

If your personal data is processed by us, you have the following rights under Articles 15–22 of the GDPR:

  • Right of access (Art. 15) — request a copy of the personal data we hold about you.
  • Right to rectification (Art. 16) — correct inaccurate or incomplete data.
  • Right to erasure / "right to be forgotten" (Art. 17) — request deletion of your data.
  • Right to restriction of processing (Art. 18).
  • Right to data portability (Art. 20) — receive your data in a structured, machine-readable format.
  • Right to object (Art. 21) — particularly to processing based on legitimate interests.
  • Right to withdraw consent at any time, without affecting the lawfulness of processing already carried out.

You also have the right to lodge a complaint with the Spanish Data Protection Authority (Agencia Española de Protección de Datos, AEPD): www.aepd.es.

6. Security

We apply reasonable technical and organisational measures to protect personal data against unauthorised access, alteration, disclosure, or destruction — including TLS encryption in transit, restricted access to the mailbox receiving contact-form submissions, and timely security updates of the hosting environment.

7. Children

The Website is not directed at children under 16. We do not knowingly collect personal data from children. If you believe we may have such data, please contact us and we will delete it.

8. Changes to This Policy

We may update this Privacy Policy from time to time to reflect changes in our practices, the services we use, or legal requirements. The "Last updated" date at the top of this page indicates when the most recent change was made. We encourage you to review this page periodically.
